Terms of business

These terms govern contracts between Genovese Consulting, S.L., Calle de Isabel Colbrand 6, Fiteni VII, 28050 Madrid, NIF B05627419, and you as the customer for building, hosting and maintaining a website. «Sitomat» is the brand under which this company offers the service; «we» in these terms means Genovese Consulting, S.L..

1. Scope

They apply to all website orders. The version you confirm when accepting the offer applies. Deviating terms of yours apply only if we confirm them in writing.

2. What we do

We build your website, put it live and keep it running. The exact scope is in your offer. Every order includes hosting with a security certificate, setup and management of your domain, content changes you send us, and a fixed contact person.

3. See first, then pay

After the first call we build your website. You see it finished, on your phone and on your computer, before you sign anything. Only when you say yes does the contract arise: you accept the offer, usually through a personal link, with a simple electronic signature. We store name, role, time, IP address and device identifier as evidence and send you the signed document as a PDF.

4. Online within 48 hours

From your yes, your website is reachable within 48 hours, with domain and everything that belongs to it. If you bring an existing website, we move it: domain, content and old addresses. For this we need your cooperation, in particular access to the domain or the possibility to set the required records.

5. Content and rights

Content you deliver stays yours; you grant us the right to use, edit and store it for your website during the service. You confirm that you hold the necessary rights to all content you deliver or that we take, with your agreement, from your existing website or public profiles. Part of the texts and images we generate with artificial intelligence; we review the result before it goes live, and you confirm the accuracy of the details about your business when approving.

6. Price and payment

The prices in your offer apply: a one-off setup fee and a monthly fee. Amounts are in euros plus VAT. Content changes are included in the monthly fee. A new element (another page, another language, another form) is an additional order as per offer. The setup fee is due when work starts after your yes; the monthly fee from the day the site goes live. Invoices are payable within 30 days; the monthly fee by card through our payment provider Stripe.

7. Term and cancellation

The term is twelve months from going live. Afterwards you can cancel any month to the end of that month; an e-mail is enough. The setup fee is not refunded. Both sides may terminate with immediate effect for good cause, for example unlawful content.

8. The website is yours

The domain belongs to you; we register or manage it in your name and transfer it to you or your new provider on request, also after a cancellation, at no extra cost. At the end of the contract we hand over your content if you wish, take the site off the net, keep your data for another 30 days and then delete it.

9. Availability, warranty and liability

We aim for continuous operation without owing a specific availability; short interruptions for maintenance are possible. Defects you report within ten days of going live we fix free of charge. We owe a carefully built, working website; we do not guarantee a specific business result such as search rankings or a number of enquiries. We are liable without limit for damage caused intentionally or by gross negligence; otherwise our liability is limited, as far as the law allows, to the amount you paid us in the twelve months before the event.

10. Data protection and reference

We process personal data under the GDPR; details are in the privacy policy and, for data we process on your behalf, in the data processing agreement we provide. We may name your website as a reference, with name and image; if you prefer not, a message is enough. At the foot of your website stands a discreet note that Sitomat built it.

11. Governing law

Spanish law applies. Place of jurisdiction is Madrid. Should a clause be invalid, the others remain in force.
